Terms of Service

These Terms of Service ("Terms") govern your use of the ThriftMedia mobile application and thrift-media.com (the "Service"), operated by Clear Path Estate Sales LLC, doing business as ThriftMedia ("ThriftMedia," "we," "us"). By using the Service you agree to these Terms.

The Service

ThriftMedia is a marketplace platform that connects estate sale companies, auctioneers, and shoppers. We list sales and auctions; we do not run them, own the items sold, or participate in transactions between buyers and sellers at sales. All purchases at estate sales and auctions are strictly between you and the seller.

Accounts

• You must be at least 13 years old to use the Service and at least 18 to create a company or auctioneer account.
• You are responsible for your account credentials and all activity under your account.
• Company and auctioneer accounts must provide accurate business information. Auctioneers are responsible for holding any license their state requires.

Listings and fees

• Companies and auctioneers pay a per-listing fee and/or subscription as shown at the time of purchase. Fees are non-refundable once a listing is published, except where required by law.
• Listings go live immediately. We may remove listings that violate these Terms, with or without notice.
• You must have the legal right to sell the items you list and to use the photos you upload.
• Listing addresses are public. Only post an address you are authorized to disclose.

Content rules

You may not post content that:

• Infringes anyone's copyright, trademark, or other rights;
• Is false, deceptive, or misleading;
• Is unlawful, harassing, or obscene;
• Lists items that are illegal to sell in your jurisdiction.

You retain ownership of content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as part of operating and promoting the Service.

Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to legal@thrift-media.com including the information required by 17 U.S.C. § 512(c)(3). We will remove infringing content and terminate repeat infringers.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not verify the accuracy of listings, the condition or authenticity of items, or the conduct of buyers or sellers. AI-generated price suggestions (SnapSheet) are estimates for informational purposes only and are not appraisals. Visit sales at your own discretion.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIFTMEDIA'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANYTHING THAT OCCURS AT A SALE OR AUCTION LISTED ON THE SERVICE.

Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

Changes

We may update these Terms. Material changes will be announced in the app or by email at least 14 days before they take effect.
